1. Purpose

These Terms and Conditions of Sale (TCS) define the terms and conditions under which Studio Up – AIT HAJ KADDOUR Mehdi (hereinafter "ASAVA") provides its users with access to its AI-assisted after-sales service (customer support) management platform, as well as all associated services (hereinafter "Services").

By using the ASAVA platform, the user acknowledges having read and unconditionally accepts these TCS.

2. Description of services

ASAVA is an AI-powered SaaS platform that enables businesses to automate and optimize their after-sales service management. Services offered include:

  • AI-powered automated processing of incoming customer support requests
  • Ticket categorization and prioritization
  • Generation of suggested or automatic responses
  • Dashboard for tracking and analyzing customer support performance
  • Integrations with third-party tools (CRM, messaging platforms, e-commerce platforms, etc.)
  • Customization of processing rules and workflows

Access to services is conditional upon creating an account and subscribing, after any use of the free trial period.

3. Free trial

ASAVA offers a free trial period allowing users to discover the platform's features without financial commitment.

  • The duration of the trial period is specified on the Pricing page of asava.tech.
  • No credit card is required to access the free trial, unless otherwise stated.
  • At the end of the trial period, access to services is automatically suspended unless a paid subscription is taken out.
  • The free trial is limited to one account per user and per company.

4. Ordering and access to services

Orders

Orders are placed exclusively online via the asava.tech platform. The user selects the subscription that matches their needs and proceeds with payment via Lemon Squeezy, our payment provider.

Access to services

Upon payment validation, access to services is immediate. The user then benefits from all features included in their chosen plan.

Lemon Squeezy – Official reseller

Payments are processed by Lemon Squeezy (Lemon Squeezy, LLC), which acts as Merchant of Record. As such, Lemon Squeezy is legally responsible for the transaction, invoicing and collection of applicable VAT. Lemon Squeezy's terms of use apply jointly with these TCS for all payment processing matters.

5. Pricing and payment

Pricing

Applicable prices are those displayed on asava.tech at the time of order. They are shown in euros, all taxes included (TTC). ASAVA reserves the right to modify its prices at any time, without affecting current subscriptions until their renewal.

Subscriptions

Subscriptions are offered on a monthly or annual basis. They are automatically renewed at expiry, unless cancelled by the user before the renewal date under the conditions set out in Article 8.

Payment

Payment is due in full at the time of order or renewal, via the payment methods offered by Lemon Squeezy (credit card, etc.).

Right of withdrawal

In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to services fully performed before the end of the withdrawal period, when the user has expressly waived their right of withdrawal by checking the corresponding box at the time of order.

For users who have not yet received the service, a withdrawal period of 14 days from the date of subscription may apply in accordance with applicable regulations. To exercise this right, the user must contact contact@asava.tech.

6. User responsibility

Use of services

The user is solely responsible for their use of the platform and the customer support responses generated. They must ensure that their use complies with applicable laws and does not infringe the rights of third parties or their own customers.

Data and settings

The user agrees to provide accurate information and correctly configure their settings (processing rules, workflows, integrations, etc.). Any error or omission may result in incorrect responses for which ASAVA cannot be held responsible.

Customer data

The user is responsible for the personal data of their own customers that they import or process via the ASAVA platform. They agree to comply with applicable data protection regulations (GDPR).

7. Disclaimer and limitation of liability

Generated content and responses

Responses and suggestions generated by AI are produced automatically from data provided by the user. ASAVA does not guarantee their accuracy, relevance or suitability for each particular situation.

No warranty

The service is provided "as is", without express or implied warranty. ASAVA does not guarantee that the services will meet each user's specific needs or that they will be available without interruption.

Liability

The user uses the service at their own risk. ASAVA shall not be liable for any direct or indirect damages resulting from the use or inability to use the service, including commercial losses, data loss or damage to reputation.

8. Intellectual property

Platform and technologies

The technologies, algorithms, methods and interfaces used by ASAVA remain the exclusive property of Studio Up or its partners. Any unauthorized reproduction or use is prohibited.

User data

Data imported or generated by the user on the platform remains their property. ASAVA claims no ownership rights over this data and undertakes not to use it for purposes other than providing the services.

9. Suspension and termination

Breach of TCS

In the event of non-compliance with these TCS, ASAVA may suspend or terminate access to services without notice or compensation.

Termination by the user

The user may cancel their subscription at any time from their account or by contacting contact@asava.tech. Cancellation takes effect at the end of the current subscription period. No pro-rata refund is made for unused periods.

Termination by ASAVA

ASAVA reserves the right to terminate a subscription in case of abusive, fraudulent or non-compliant use, without refund.

10. Support and assistance

Support is available by email at contact@asava.tech. All requests will be processed as soon as possible. ASAVA undertakes to make every effort to resolve reported technical issues, without being able to guarantee a resolution time.

11. Applicable law and jurisdiction

These TCS are governed by French law. In the event of a dispute, an amicable resolution will be sought before any legal action. Failing amicable agreement, the competent courts of Saintes (France) shall have sole jurisdiction.

12. Final provisions

Acceptance of these TCS is required for any order or use of ASAVA services. Any subsequent modification will be published on asava.tech and will apply to new orders from the date of publication.
